About the role

The Senior Compliance Official will form part of the Compliance team and work closely with the team to assist in advising and overseeing the various business lines in their conduct of business obligations. Together with other team members, he/she will be responsible to execute a 360-degree ongoing compliance-monitoring programme for the respective entities within the group. This will involve the design, review and implementation of policies and procedures, training, monitoring of conduct of business and ensuring the adoption of best practices within the industry. The Senior Compliance Official reports directly to the Head of Regulatory Compliance.

  • Assume responsibility for the general day-to-day duties in the compliance department 

  • Actively participate in the execution of the Compliance Monitoring Programme 

  • Provide guidance and advice on regulatory matters to various business lines 

  • Conduct gap analysis and develop and track action plans to address any gaps and regulatory requirements 

  • Remain abreast with new regulations and circulars and engage in continuous learning and development regarding changes in rules and regulations that would require to be implemented 

  • Other duties as assigned by the Head of Regulatory Compliance from time to time 

Job requirements

Job Requirements

The ideal candidate should possess a sound understanding of the regulatory framework governing financial services in Malta, with particular emphasis on investment services and financial institutions. The following qualifications and experience are required: 

  • Tertiary degree in finance, legal studies, or a related discipline and/or a post-graduate qualification in compliance 

  • Relevant experience within a regulated financial services environment or with a regulatory body 

  • Demonstrable understanding of Maltese and EU financial services legislation, including but not limited to MiFID II, the Investment Services Act (Cap. 370), and the Financial Institutions Act (Cap. 376) and MiCAR and applicable rules. 

  • Experience in the development and implementation of compliance monitoring programmes 

  • Excellent written and oral communication skills in English

  • Strong analytical skills with the ability to assess regulatory and compliance risk and implement effective mitigation measures 

  • Excellent written and oral communication skills, with the ability to present complex regulatory matters clearly to various stakeholders 

  • High degree of professional integrity and ethical conduct 

  • Meticulous attention to detail and a structured, methodical approach to work 

  • Good organisational and time management skills, with the ability to manage multiple priorities 

  • Collaborative team player with the ability to work independently when required 

Required Areas of Expertise

Regulatory Environment of Financial Institutions in Malta 

Candidates must demonstrate a thorough understanding of the regulatory landscape applicable to financial institutions operating in Malta, as governed by Maltese legislation and European Union directives and regulations. This includes: 

  • In-depth knowledge of the Financial Institutions Act (Cap. 376 of the Laws of Malta) and the regulatory requirements imposed on licensed financial institutions, including payment service providers and electronic money institutions 

  • Familiarity with the Malta Financial Services Authority (MFSA) regulatory framework, including applicable rulebooks, circulars, and guidance notes issued to financial institutions 

  • Understanding of the Payment Services Directive (PSD2) and its transposition into Maltese law, including strong customer authentication, open banking obligations, and safeguarding requirements 

  • Awareness of consumer protection and conduct of business requirements applicable to financial institutions, including transparency, complaint handling, and fair treatment obligations 

  • Understanding of capital adequacy, liquidity, and prudential requirements applicable to financial institutions operating under Maltese law 

  • Familiarity with European Banking Authority (EBA) guidelines and technical standards applicable to financial institutions, and their implementation within the Maltese regulatory context 

MiCA and Crypto-Asset Regulation 

Given the evolving nature of the digital assets space and Malta's role as a jurisdiction with established virtual financial assets legislation, candidates are expected to possess the following: 

  • A sound understanding of the Markets in Crypto-Assets Regulation (MiCA) (EU Regulation 2023/1114), including its scope, the classification of crypto-assets (asset-referenced tokens, e-money tokens, and other crypto-assets), and the applicable authorisation and ongoing compliance obligations 

  • Understanding of the role and obligations of the MFSA as the competent authority under MiCA in Malta, including notification requirements, passporting of services, and supervisory cooperation within the EU 

  • Knowledge of the Travel Rule obligations applicable to crypto-asset service providers under the Transfer of Funds Regulation (TFR) as extended to crypto-assets 

  • Awareness of AML/CFT obligations specific to the crypto-asset sector, including FATF guidance on virtual assets and virtual asset service providers (VASPs), and the corresponding Maltese implementing measures 

  • Understanding of the intersection between MiCA and other applicable EU legislation, including MiFID II (in relation to crypto-assets that qualify as financial instruments), PSD2, and DORA (Digital Operational Resilience Act) 

  • Ability to advise business lines on the classification of crypto-asset products and services and the corresponding licensing and conduct of business requirements under MiCA and applicable Maltese law 

Nice to Have

  • Experience in mentoring or training junior team members, with the ability to transfer knowledge effectively 

  • Familiarity with industry systems and tools used in fund administration 

  • Professional qualification (e.g. ACCA, ACA or equivalent), or in progress 

  • Experience working directly with auditors and regulatory reporting 

  • Experience with a variety of fund types (Hedge Funds, Private Equity, Real Estate, etc.)
